Terms of Service

Effective May 16, 2026

1. Acceptance

By using Mailgrid you agree to these terms. If you don't agree, don't use the service.

2. Acceptable use

You agree not to send:

• Spam, unsolicited commercial email, or anything violating CAN-SPAM, CASL, or GDPR-PECR.
• Phishing, malware, scams, or content impersonating others.
• Illegal content under applicable law.
• Email to addresses you don't have permission to contact.

We reserve the right to suspend accounts that breach these rules without refund.

3. Deliverability

You're responsible for your sender reputation. AWS SES (our outbound gateway) will pause your sending if your bounce rate exceeds 10% or complaint rate exceeds 0.5%. Mailgrid auto-suppresses bounced/complained recipients to help.

4. Payment

• Free tier: 3,000 emails/month, no card required.
• Scale: $0.40 per 1,000 emails, billed monthly in arrears.
• Enterprise: custom contract.
• Past-due balances over 30 days result in service suspension.

5. Service level

Scale and Enterprise plans target 99.99% monthly uptime. Free tier is best-effort. Outages caused by upstream providers (Cloudflare, AWS) are excluded from SLA credits.

6. Data ownership

You own your data. We process it solely to provide the service. See the Privacy Policy for details.

7. Liability

Our total liability for any claim is capped at the amount you paid us in the 12 months preceding the claim. No liability for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate the relationship at any time. On termination, your data is retained 30 days for export, then permanently deleted.

9. Changes

We may update these terms. Material changes will be announced via email at least 30 days before taking effect.

10. Governing law

These terms are governed by the laws of the State of Delaware, USA, unless your contract specifies otherwise.
